hello client as you have mentioned the case about your grand mother who died intestate the over property need yo be divided by all 5 childrens in this matter tou have to go through legal remedies then only it will be possible for all 5 brothers and sisters to get divided property among themself as per your wish
for tht you need to file a legal case in the appropiate forum of juridiction in the conpetent court.
Dear querist,
since your grandmother died intestate the property shares will be devolved through intestate succession. Accordingly, each shares of the property will devolve 1 x 50 share Each. Since you mentioned in your query that his successors bond 50% share to be devolved or transferred to the son and 50% to the daughters respectively, that can be done through relinquishment deeds in the favour of the transferee By virtue of which the ownership will be transferred as per the successors wish and the property will be mutated on the basis of that.
There has to be relinquishment deed executed by the respective parties who relinquish their part or respective shares in favor of the other parties. Though after the death of your grandmother, all the son and daughters have equal share in the property but if the parties want to settle it otherwise, they can certainly do so by executing either relinquishment deed or family settlement deed.
