Stamp duty from previous onwer

Hi Lawyer team, I (am a Christian) purchased a flat in 2005 from the 2nd owner in MHADA premises by providing all the required documents (registration fees and stamp duty). Society is now 40 years old and will start for re-development in Pune. When i reached MHADA office they told me that the 2nd owner have not complete stamp duty formalities and now have to pay the amount. Do i need to pay the amount of the 2nd owner? Regards, Wilson

My Response to your query:

You have to inform this fact to previous owner that pending dues which not paid.

You are only lible to pay dues charges after date you purchase when you purchase.

Yes, ideally you are suppose to check whether previous stamp duty is paid by the 2 nd owner, as all transfer above value of Rs. 100 need to be registered, and for immovable property stamp duty has to be paid. Also check with the previous owner for receipts of stamp duty paid, between 1st and 2 nd owner.
