Staking claim on my Bua's property after her death

28-May-2023 (In Property Law)
My late Grandfather gave a portion of the house to my Bua who was unmarried all through and we did not have very good terms with her. She died recently. We do not know if she has willed the house to anyone. Can my father or I stake our claim on this property now as legal heirs as she did not have a family of her own

yes you can claim the ownership on the property of your own late Bua after getting legal heirs certificate. you should file suit for declaration in the civil court and made parties to all the other legal heirs of your Bua. if you're Bua had given this property through will then this fact will come during the proceeding before the court. I don't think that your Bua had executed any will. if she had executed will then certainly this fact should be disclosed by the person in whose favor this will was executed. you can call me for any other advice

Yes, you can claim it only incase you know it affirmingly that she not transferred her property by means of a will or any other form of conveyance deed. This, you first need to find our the status of this property by way of verifying the current status as to who is presently occupying this property, and whether the person occupying/in possession of the property was transferred the ownership right by your BuA
