Son's right on Mother's property being given to daughter alone
14-Dec-2023 (In Property Law)
We are hindus. we are 3 sons and 1 daughter to my parents. My father expired about 2 years back and there was a property on my mothers name. All we 3 sons are not having good contacts with my mother. My mother wants to give all the property (registered on her name) to my sister. Is there any right to us as sons on that property. Please reply me sir.
Hi,
You said that property is in the name of your mother so it cannot be divided between all the legal heir now and as she wants she can give it to any person of her choice I. end sister or even she can donate it is her property alone.

If your mother acquired property through registered deed then she is absolute owner then she can alienate the as per her will nobody can challenge. If property acquired with conditions then persons who effected by violation conditions can file suit for injunction
if the property which belongs to your mother was devolved upon her absolutely it is her right to dispose and you cannot seek for share and if the property is a join hindu family property devolved upon her from your father you can claim your share right by birth under section 6 of the hindu succession act
