Society wants to build a society gate which would block my home entran
18-Feb-2026 (In Property Law)
I live in a housing society in Gujarat. My house is first house of the society row. Now recently the society chief wants to built a common society gate from my house to my opposite house. Now the problem is that they want to build a swing gate which would open inwards and block my house entrance. How can I legally oppose this construction ?
With respect to the issue of the proposed society gate that may block the entrance of your house, the first step we should take is to issue a formal legal notice to the Society Chairman and Secretary.
In the notice, we will clearly mention that the proposed swing gate opening inward will obstruct your lawful right of access and peaceful enjoyment of your property. We will request them to either modify the design (for example, by installing a sliding gate or adjusting the opening direction) or reconsider the construction in a manner that does not interfere with your entrance.
If the society is willing to resolve the matter amicably and agrees to a reasonable modification, then the issue can be settled without further legal action.
However, if they ignore the notice or proceed with construction despite objection, we can initiate legal proceedings by filing a civil suit for injunction to restrain them from carrying out any construction that blocks your access. We may also seek a temporary stay order from the court to immediately stop the work.
Please let me know if you would like us to proceed with issuing the legal notice.
