22-Apr-2023 (In Property Law)
In our society somebody planted a coconut tree in 2007. Now tree is grown big. And there is is a septic tank in distance of one and half metre from the tree. Because of some reason society dig around the septic tank. And and now they are saying that coconut trees roots is damaging septic tank. It can be clearly visible that tree roots are not damaging septic tank. We are saying that we can build small wall before septic tank that can protect safety tank but society is is refusing it. What action should be taken on this by law . Hoping I will gate right decision from you. thank you

As you said that the roots of coconut tree are not damaging septic tank and since the tree is a fully grown if you want to protect the tree , give a written complaint to the concerned officer of the ward of Municipal Corporation and to the tree Authority of Municipal corporation. They will take appropriate steps to save the coconut tree.

If you see the society calling the municipality officials for cuttings of trees in the society you can complain against the erring persons including the other society members who are involved in this apart from that you can write a letter to the managing committee to not go ahead with such cuttings of trees to place on record your defence as a member of the society
