Society is asking for security deposit to issue NOC
12-Feb-2023 (In Property Law)
I am requesting my housing society to issue NOC to sell my flat.In response to that society secretary is asking me to pay Rs.42420/- as a share amount divided among all society member since society has filed case against previous committee member who had done fraud with society fund. We were not a part of society when fraud was done.
Currently registrar has passed the judgement in favor of society after all verification. But previous member appeal in tribunal.Currently case is in process. Please advise if i am abide to pay amount mentioned.
This is my response to you:
1. Tell the society the MC cannot charge you so much;
2. Obtaining an NOC is a mere formality;
3. Ask the society under which bye-law are they asking you to make such payments;
4. Consult a local lawyer, discuss full facts with him/her and take steps.

Because recovery matter may be stayed in tribunal.But for which reason they want payment from you.If fraud had been done by previous committee members then that can be recovered from them by court process.You can ask him to give me written demand from society.
