Simple Interest or Compound Interest is applicable as per law

My father had a property sale agreement done in 1995 later owner of the property refused to sale the property and case is in court till now..in the agreement there is a penalty clause if he refuses to sale but I am confused whether simple interest will be applicable or compund
I am quoting the exact sentence mentioned in the agreement
अग्रिम धनराशी मसूद ₹2 सैकड़ा महावर की डार से वसूल पावेगा
I want to know here simple interest will be applicable or compound interest
