08-Apr-2023 (In Property Law)

Sir we have purchased 2 commercial shop adjoining each other with 1 partner. The registry of both the shops is in the partners name as there were some formalities we couldnt fulfill at particular moment of registry. In mutual terms we agreed. The possession was delayed by around 1.5 yrs by the builder and the partner doesnt want to buy shop now and he is saying if u have to buy 1 shop,u have to purchase from me.The rates of front and back shop is 7500 and 6500 respectively.we wanted to buy back shop but he is saying he had already committed to someone for that particular shop .What to do now?

It is very difficult situation as now this has become serious and complex legal dispute.

In the above situation, there is no alternative but to file civil suit in the court and take injunction that your partner should not sell the shop to any other person except you.

but you will have to file the suit urgently as there is very high probability that your partner will sell it to any outsider and then you will left with no choice and option.

Hope this helps !
