Share of wife in property and cost of registration and tax

Hi I am planning to buy a property in my name and have two questions.. 1. What will be the legal right of my wife in that property in case a separation happens. 2. If I register this property in my father’s name or joint, approx how much it cost to get it registered back to my name and what is the tax implications.. Thanks

Sir, if you get the property registered in your name then your wife and your children will be the legal heirs in that as per the Hindu Succession act, so her share depends on the no. of children you have and incase you get it registered in your father's name then you ought to have a registered will in your name and then mutation has to be done and thereafter new deed will be registered in your name. A well-learned counsel will be able to help you out in this case to draft deeds as law and the will and do all the legal-implications. Regarding the registration, the stamp-duty and registration charges are to be paid for the registration of the deeds.

Hi, as it will be your self acquired property, you may purchase it on your name and thereafter, sell it off to anyone you feel like. Your wife will have no claim over your property till you are alive.After your death, she shall have right over the property. If you dont want your wife to have any claim over your property then you may get a will registered in the name of the person you want the property to be.
