Share of the mother in the property of deceased son

My son has committed suicide nd he has a wife and son who dont use to live with us when he was alive and never even attended his funeral. My son had an agricultural land of 10 acres. Now his wife is claiming the property. I have debts and iam being not allowed to sell the property. What is the right i could claim nd how i shud claim. Please suggest sir. My daughter inlaw didnt even come to my home once as she lives wit her parents nd not evenallowing me to meet my grandson till tday. My daughter inlaw is taking my brother son help who lives near the land nd he s also obstructing me in selling my son land and telling that i should pay him 15 lakhs to sell the said land. Plz advise sir as iam in lot of problems... my son bought the land wen he was unmarried...

Each of the primary heirs shall have an equal right over the Son’s property. Thus you, your son’s wife and your grandson all have an equal claim over his property. You are only entitled to your share and not the entire property. The daughter in law has a right to claim her share, regardless of whether she was actually living with your son or not, as long as she can establish that she was his lawfully wedded wife.

Hi,
You are entitled for share in the land but you all alone cannot sell the land as both of you are legal heir of deceased, without both joining land cannot be sold. You have to sit down with her and settle the indifference. If it is not getting settled then you have to file partition asking your share. Call us through website for assistance
