Share of elder brother property with younger brother
07-Apr-2023 (In Property Law)
Sir, I want to know that ,is there any law that give right to younger brother to take property from elder brother self occupied property. If elder brother bought that property on his name and the younger one is minor at the time of property bought. Actually my father (elder one) was in cisf force and bought some farm field on his name and gave to his younger brother for using that field. Till that time we (my mother and My brother) are living with my father at cisf quarter. Now when my father had retired from his service and want their property back. Then his younger brother forcefully want to take share from that field . And my uncle threating my father to kill if property is not shared. My father is ready to give his ancestral property share to him for any settlement .but someone had told them they have the right to take share of property from elder brother.is it right please reply.
Hii,
You have been misguided. Laws of succession differs from religion to religion. However, no law states that a legal heir has a share in the self acquired property of a person. Regarding the threat to kill, you lodge an FIR in your nearby police station, If the police station refuses to take your FIR, you write a letter to DSP of that police station and send it by post, also mark a CC to CBI and DCP so that everyone is in check.
