share in ancestral property to daughter

14-Aug-2023 (In Property Law)
we have an ancestral house in the name of my maternal grand father who passed away in 1995. he has 3 sons and 2 daughters, my mother was the eldest daughter but she is no more, she passed away in 2002. Can we (her daughters) claim her share of the property. Since she passed away in 2002, is the equal rights to daughters applicable in this case? kindly advise. Thanks

Law has been well settled that daughters are entitled to get share on par with sons. The law has been settled by the Supreme Court in Danamma'S case. I will file a suit for partition and get you your mothers share in the ancestral property.

Sir, you can claim your mother's share and equal rights to daughter,s. You may partition the property through the registration of partition deed or if any complication arised between you and your family, you can move a court to file a partition suit. If you need any further advice or document verification please contact me then I will give you full advice about this property.
