The buyer can file a civil suit under specific relief act for specific performance of contract i.e. agreement to sell. He can also ask for the ad interim injunction orders to restrain the seller from transferring the property to anyone else and not to interfere in the possession of the buyer .

You can file the case for specific performance of agreement to sell. It is wrong to ask for additional amount as the consideration has already been locked at 98 lakhs. The delay was because of seller only.
