Q: Property transferred by mother to son with no claim clause
Mother transfered plot to son with undertaking that neither she nor any of her legal heirs will file any claim upon this property. Son and his wife constructed house on this plot by taking joint housing loan.After 10 years son expired . I have two questions 1. Whether she can apply for cancellations of transfer deed.2. Whether she can claim her share under succession act in violation of her earlier undertaking Please also quote legal judgements

If the transfer by mother was made through registered transfer deed, she cannot cancel the same, unless there are some exceptional circumstances which I can tell after seeing the documents. Otherwise the mother can claim her share as per Hindu law and the earlier undertaking has nothing to do with it. Both the cancellation of transfer deed and claiming share under succession act will have different effect on share. I have the judgments but would them in further meeting.
Q: Seller declined to execute sale deed
Sale agreement dated 12.04.24 for ₹98lacs. Advance given through RTGS ₹25lacs. Seller couldn’t not register Sale Deed till due date 12.07.24. Time extended up to 12.10.24. Ban of PPCB on sale of property vacated on 12.12.24. Seller declined to execute sale deed. Asking for additional value ₹10lacs for delayed period and increase in rates. Sale agreement has expired. Possession with the buyer on rent basis from 01.08.24 for 11 months @25500/- per month

You can file the case for specific performance of agreement to sell. It is wrong to ask for additional amount as the consideration has already been locked at 98 lakhs. The delay was because of seller only.
