Sell agreement expire & need to exit from agreement

Dear sir/mam, I have a 2bhk flat.A Seller agrees to purchase in 18lac & do a agreement for 45 days. Gives me token money of 1 lac. There is no condition to deduct the money after the end of the agreement. Because I didn't get seller for a long time. But he got a loan of 13 lacs from the bank & he did not agree & the agreement expired after 45 days. Now he makes the agreement again for 30 days. Then the agreement mentions that 50% of the amount will be deducted if the agreement again expire without flat registration. Banks agreed to give a loan of 10 lakh rupees. But he did not agree. Since then he is not picking up the phone.Again the agreement date will be over on 8th November. What should I do?nnNow I get another customer who is agree to buy my flat. Am I do agreement with a new buyer after 8th NovemberHow to release from old buyer. Please suggest.

It is necessary to scrutinize the present Sale Agreement for its scope, meaning, effect and default clauses. Without revoking the present Sale Agreement, you cannot enter into another Sale Agreement with another prospective buyer because then there will be litigation possibility. As per your query in law rato, you need to send legal notice for cancellation of agreement before entering into any agreement with any purchaser. First cancel and send the legal notice and then enter into any agreement.
