Sell a Plot on the basis of Sale Deed without name on 7/12

24-Feb-2023 (In Property Law)
I have purchased an agricultural plot of 5000 sq ft in the year Feb 2019 through a property agent who deal into plotting of agricultural land. I have a registered sale deed done with the owner of the plot. Now, I would like to sell the plot to a prospective buyer who is interested in purchasing the plot I just bought. But the problem is that the mutation entry and transfer of name on 7/12 are yet to be done. My question's to you are, 1. Can I sell the plot without my name on the 7/12, based on the sale deed? How can that be done? 2. Is it necessary to transfer the name on 7/12 before selling & mutation entry be done? Since, I am anyways selling the plot.

Yes,
you can sell plot on the basis of sale deed .But that sale deed certified copy must be attached with new sale deed.Thereby your cost for sale deed can be increased. But what is your difficulty you are not waiting till mutation entry take place on 7/12 extract.
