Searching for the most cost effective way for ownership transfer

08-Jul-2026 (In Property Law)
I wish to get a property present in Mumbai Suburbs transferred on my name. Presently the property is owned by my mother and she is willing to transfer the ownership in my name. My sibling is also ready to provide an NOC for the same. We are looking for the most convenient and cost effective way to get the ownership transferred. Kindly suggest.

Your mother can transfer the property to you through a registered Gift Deed, which is usually the most convenient and cost-effective option for transfer between close family members in Maharashtra. Your siblings NOC can be kept on record, and after registration, the society share certificate and municipal records should be updated in your name.

If the property is owned by your mother and she wishes to transfer the same in your favor then the best and cost effective way would be either to execute a Will or get a gift deed registered. Feel free to contact me for seeking any legal advice/assistance as regards the same.

Since your mother is the absolute owner and is willing to transfer the property during her lifetime, the most practical and cost-effective option is usually a Gift Deed in your favour. In Maharashtra, a gift between specified family members attracts concessional stamp duty, making it more economical than a sale transaction. The Gift Deed must be duly stamped and registered before the jurisdictional Sub-Registrar. Your sibling's NOC is not legally mandatory if your mother is the sole and absolute owner, but obtaining one can help avoid future disputes. Before proceeding, verify that the property has a clear title and is free from encumbrances.

Since your mother is the absolute owner and is willing to transfer the property, a registered Gift Deed is generally the most convenient and legally secure option. Your sibling's NOC may also be kept on record to avoid future disputes, if required. The exact stamp duty and registration charges will depend on the property details and applicable Maharashtra laws. The most convenient and cost-effective option is for your mother to execute a registered Gift Deed in your favour. Since it is a transfer from mother to son/daughter of a residential property in Maharashtra, a concessional stamp duty is available, making it the most economical mode of transfer in most cases. Registration is compulsory for the Gift Deed to be valid. Your sibling's NOC is generally not legally required if your mother is the absolute owner of the property and is transferring it during her lifetime.
