One residential plot which was given on rent at Ranikhera west Delhi is sealed by dpcc without any notice. The tenant was running a segregation unit for plastic. How to get it desealed. Who will deseal it. What is the penalties the tenant has to pay. Is the panalty as per square foot or square yards.
Desealing will happen once representation is made to the Monitoring Committee. Sealing and Desealing issues are directly supervised by the Monitoring Committee. Further and better particulars are needed for an effective opinion.

1. Delhi Pollution Control Committee had issued show cause notices on 21st June 2019 to 1600 units in Delhi under Section 5 of EP Act read with Plastic Waste Management Rules 2018.
2. Your tenant was supposed to reply to the notice within 15 days and get approval for further operating the plastic segregation or close the unit.
3. Since you were not informed by the tenant about the notice and are willing to not operate a plastic segregation plant you can first approach DPCC and it would depend on their discretion. Afterwards you can approach the National Green Tribunal for directions.
4. The amount of penalty imposed will depend on the how much pollution the industry causes, the size of the unit and other mitigating factors.
5. You can pay the penalty if any to get your premises desealed if it's urgent and then file a civil suit for recovery of the fine you paid for the tenant's polluting industry.
