Schedule of Properties was not included in High Court SA Decree copy
21-Jul-2026 (In Property Law)
I have received the Second Appeal Judgement and Decree copy for Madras High Court. Am not able to see the 'Schedule of Properties" in the Decree copy. Is there any way to include the `Schedule of Properties` in Decree.
Yes, if the decree has omitted the Schedule of Property, it may be possible to have it corrected depending on the circumstances. First, verify whether the schedule forms part of the judgment, plaint, or the decree as passed by the High Court. If the omission is only a clerical or accidental error, an application for correction under Section 152 of the Code of Civil Procedure, 1908 can be filed before the High Court seeking amendment of the decree by incorporating the property schedule. If the decree is otherwise in conformity with the judgment and no clerical mistake exists, the remedy may differ depending on the facts. It is advisable to have the judgment, decree, and pleadings examined by an advocate before taking further steps.
Yes, it is possible, depending on the nature of the decree and judgment. If the Schedule of Property was omitted from the decree due to a clerical or accidental error, you may file an application before the High Court seeking correction or amendment of the decree. If the judgment specifically refers to the schedule but it is missing from the decree, the Court may direct incorporation of the Schedule. Obtain certified copies of both the judgment and decree and verify whether the omission is accidental. The appropriate remedy may be an application for correction/amendment of the decree or for drawing up a proper decree in accordance with the judgment. A detailed examination of the judgment and decree is necessary before advising the exact procedure.
