Sale of land through GPA and Govt vesting of the sold land after sale

24-Nov-2024 (In Property Law)
Through my GPA,my brother sold my land in August 1984.The buyer had not done mutation, subsequently Govt vested the land. Now the buyer registered complaint against me and my brother in CrPC406/420/34.Can he do it? Is Limitation Act applicable? If Govt vests the land after the sale, where is our fault? My brother did the sale without my knowledge and not paid me the money and I am aware of the sale NOW.

Since the vesting happened after the sale, you are not liable for any criminal act. If you file a quashing application in the high court your criminal case will be quashed (put an end to) by the high court. Further, you can file a case against your brother claiming your portion of the sale proceeds and you will rightfully get your share. Please contact us for more details
