Sale Of Flat After Transfer of Share Certificate in my name?

After death of my father, Share certificate has been transferred in my name. Can I sell the flat now?

if there r no other legal heirs, then u can. usually people purchasing the flat can ask for succession certificate. if there r any other legal heirs apart from u, then u will require their consent or no objection for the same.

You may first bave to check the other legal heirs, having claim on the said property example your siblings and mother. (as survived). In case you are a Hindu division of Property will happen accordingly.

It needs to be checked where Will was executed by your father before his death. In case yes, it needs to be probated.

Upon, ensuring the two above, you may seek NOC from your siblings, as an abundant caution.

Thereafter sell the flat to concerned purchaser, making all your legal heirs as confirming parties to transaction.
