Sale of a Residential House Property
19-Jun-2023 (In Property Law)
We have a residential property which was on my grandfather's name that got inherited to my father with oral relinquishment of share by his 5 sisters out of which 1 has been living in this house since she was born and is unmarried. The said house got redeveloped and the redeveloped house agreement is on my father's and mother's name jointly. A few years back, my father passed away and now we wish to sell the house. Now we are a family of four being my mother, my brother, my father's unmarried sister and myself living in the house and the other 4 sisters of my father are married and settled. In case of a sale, how will the sale consideration be divided and among who all and in what ratio?
Religion: Hindu
This is my response to you:
1. You will have to state complete facts of the case;
2. There is no oral relinquishment if not adduced by further evidence of the same;
3. You will have to enter into a deed of relinquishment first and then take steps related to your family share;
4. Consult a local lawyer and take steps.

As per Hindu Succession Act as per the new amendment's that took place daughters are also termed as with equal right within the ancestral property. Now there will be equal shares among all sisters and brother. If sisters wants to relinquish there right take in writing the relinquishment deed as oral relinquishment has no value in the eyes of law.
