Sale of a joint property be sold without consent of all owners
10-Sep-2023 (In Property Law)
Dear Lawyers I stay along with my husband and mother in law we have a joint property in the same city. Now my husband and mother in law are forcing me to sell the property. But I really dont want to sell off the property as my office is nearby it. I also anticipate that they will terrorize me as in my early years of marriage I had been tortured immensely by them. I want to know the answers to the following questions 1. Can the property be sold even if I dont sign? 2. What other actions can I take to safeguard the property Thanks in advance.
Property cannot be sold by them without your consent. You will need to be present and sign infront of SRO for the sale of property.
You can file suit for injunction on sale of property. But if they are in need of money then court can order you to either sale the property and get ypur share of amount or pay them their share of money and transfer whole house on your name.

1. Can the property be sold even if I don't sign?
Answer: If your a joint owner of the property (your name is there on the property records) then they cannot sell it without your permission;
2. What other actions can I take to safeguard the property
Answer: You can send them a legal notice stating they cannot sell it. Last step is to file a suit for injunction and stay (of sale) on the property.

no , the said property can not sold without partition or your consent , if they are desire to sold the said property in his own share then u can approch to you that they are release her share . and to make relinquishesment deed. .2. if they are continuing harrase to this reason so u finally filed a case under domestic act 2005 against them.
