Yes a sale deed of immovable property should be registered. the registration act of 1908 required that any non- testamentary instrument that creates assign or limit a right or interest in an immovable property worth more than rs. 100 be registered. The tranfer of property act of 183 and the registration act 1908 both mandate that a sale deed of immovable property be registered for it to be enforced. The same should be registered at the local sub- registrar office and the requisite stamp duty must be paid Case laws: Naginbhai P Desaid vs. Taraben A. Sheth HP Puttaswamy vs. Thimmamma & Ors
