In India, installing CCTV cameras at home is generally legal and does not require police permission in most cases. However, it's important to follow certain privacy and ethical guidelines:

  • Private spaces such as bathrooms or bedrooms must never be monitored.

  • In shared living areas (like rented apartments or hostels), it's advisable to inform or get consent from other occupants.

  • For commercial establishments (shops, offices, etc.), local police departments or municipal authorities may have specific guidelines or registration requirements, especially in cities with surveillance mandates.

  • If the camera captures footage of public roads or a neighbor?s property, it may lead to privacy complaints.

While there are no national laws specifically regulating home CCTV use, data protection, reasonable expectation of privacy, and mutual respect are key considerations.

Yes, you may install a CCTV camera at the earmarked place as stated by you. However, please ensure that no act of voyeurism takes place in any manner whatsoever. Voyeurism is a criminal offence under Section 354C of the Indian Penal Code(Section 77 of BNS). It is punishable with one to three years' imprisonment and a fine for the first offence, and three to seven years' imprisonment along with a fine for subsequent offences.

Dear Client,
As per your details and in response to your queries, I would like to state that nowadays even the police are insisting the local public on the installation of CCTV cameras for proper vigilance and controlling of crime. But still, I would suggest you give a written letter to the police station and the Commissioner of Police of your jurisdiction, informing them of the installation of the camera.

There is no permission required for installing CCTV at your premises, however, if you are a resident of a complex, then you may intimate to the society and/or the maintenance committee for the same, however, the same is also not mandatory, which please note.
