Road blocked by new residential community in a village

04-May-2023 (In Property Law)

At Ameenpur village a new venture started in our colony premises. They built 40 Homes with 20 ft and 30ft Roads. They are accessing our colony road to enter into their premises. Also, all registrations are done as individual houses with GPA permission. They arranged a on the middle of the road while they are constructing homes. Now they are not wiling to remove the gate and also, they are planning to block other passing roads by saying that their community is a gated community. Please advise me how to proceed our colony members to get the gates removed and to get open all passing roads.

Hi,
First get a stay on construction in gated community.second claim declaratory title rights on passage rights ( roads in your colony). Inform municipal corporation that the construction and road blockage is in violation of building permission and hence building permission be cancelled. Please note neighbours (you) have all rights compared to builder as builder needs to first respect neighbours rights and can then only take up construction .
