07-Dec-2024 (In Property Law)
In a partition suit can a POA holder of Plaintiff cross examine Defendants witness. If yes, under which provision of law.
Please respond.
Well, a POA Holder of Plaintiff if he is having Law Degree, Requisite Experience of fighting cases at least for himself, then with the permission of Court, such POA Holder of Plaintiff can cross examine Witnesses of Defendant. However, an Advocate cannot be a POA and a POA cannot be an Advocate, which has been clarified by Courts via several Judgements.
