Once partition took place the property is ceased to be an ancestral property.Your father has absolute right to sell or mortgage or gift or even will away with the property. The 86 cents of land which your father has got through partition may have been sold for the money he has received from the lender. However, your father may scrutinize the document for any document defect while selling the property which might have a chance for you to challenge.
