Residential property lease amount cheating case

Original house owner misuse his residential property with his knowledge by handing over to a fraudulent person and that person created a lease agreement on my name(tenant), amount sent through online and fraudulent lease owner absconded

If the lease agreement was created fraudulently in your name without your knowledge or consent, you should immediately preserve the lease agreement, payment proof, bank/UPI transaction details, messages and other communications. A police complaint may be lodged for cheating, forgery and use of forged documents, as applicable. If the original owner knowingly handed over possession or authority to the fraudulent person, the owner’s role and liability will have to be examined based on the documents and circumstances. You may also approach the appropriate civil court seeking declaration regarding the validity of the lease, injunction/protection against unlawful dispossession and recovery of the amount paid, depending on the facts. Do not sign or acknowledge any further document without legal advice.

If the original owner knowingly allowed a third party to impersonate him or create a fraudulent lease in your name, and you transferred money based on that representation, there may be grounds for criminal action for cheating, forgery and use of forged documents, depending on the evidence and the exact role of each person. You should immediately preserve the lease agreement, bank/UPI transaction records, WhatsApp messages, call details/recordings and any proof connecting the original owner with the fraudulent person. File a detailed complaint with the police naming both persons and explaining their respective roles. You may also pursue a civil recovery claim for the money paid, along with appropriate reliefs. A lawyer should examine the documents before deciding the precise criminal and civil remedies.
