Rera RC issue and how much time to resolve and execute

What to do if UPRERA is not issuing the RC order and once we file a complaint how much time does it take?

Specific performance is a remedy available for certain breaches of contract. As to property law it applies to contracts dealing with transfers of rights to real property. All real property is presumed to be unique in character such that when a seller, for example, fails to tender a deed to the property an award of damages is considered insufficient because the value is legally uncertain. One can make the same argument with works of art and other unique items. The plaintiff/would-be buyer has the option to sue for specific performance consisting of a judicial decree that the property belongs to the plaintiff. The plaintiff of course must tender the agreed price to the clerk of the court and the funds will be paid to the defendant.

file a writ petition in the HC and seek directions against the RERA authority for early decision in your execution case. The High court will put your execution application before RERA on a fast track route

In case your RC is not getting executed by UPRERA then you first represent the District Authorities and thereafter can file a writ petition in the Hon. High Court for directions against the concerned DM for RC execution. Kindly Contact Us for further details
