Renovation and Alteration of Apartment

11-Sep-2023 (In Property Law)
I am from Mumbai. My society has adopted the Model Bye-Laws. I have been conducting renovations in my house and have opted to break a small portion of the wall (not interfering with the structure of the apartment or destroying the beams of the building) but according to 46(a) of the model bye-laws: No alteration/addition can be made without the prior permission of the committee. I have however continued with the renovation including the breaking of the wall. Now for context. This is not a whole wall. The wall is only upto my knees and the space it provides access to is a storage area. As a part of my renovation, I intend on breaking this wall while still maintaining access to such storage area. Thus it would neither be structural nor a functional alteration to the apartment. Please let me know if it is possible for bye-laws to be so restrictive of my own property. Can this be challenged on any other basis ? Is the committee considered a Government body ?

You have to take the requisite permission from the Society Committee for whatever alterations you said you are doing inside your flat. After receiving Society's permission, you have to take the permission of concerned Municipal Corporation too, otherwise your alteration will be deemed as Illegal.
