My wife passed away on 16th Aug 2025. Me and wife owner of a 1BHK Flat at Malad. Mumbai. Our only child (son) is Nominee. Please explain the % of share my son gets which he, then, will release to me thru the Release Deed. I was told that out of my wife's 50% share my son will get only 25% as the other 25% comes directly to me by default. Is this right? Thanks a lot, really. [email protected]

At the outset let me inform you that you want get a share by default. You will have to apply for a letter of administration. If in case your wife has made a WILL then your wife’s share will be distributed as per the Stipulations in the WILL. In case your wife passed away intestate then naturally since you are two survivors and your son being her legal heir the property will be distributed between the two of you from your wife’s 50% share in the ration of 50:50. To put it in a different way after the property is distributed you will be left with 75% share in the flat and your son will be having 25% share.
