Related to joint property ...which is in joinr name of me and my huby

I and my husband have joint flat ..he has stoped paying emi ..I am paying now...and he has submitted surrndr lettr to bank....and we are separated but not divorced...can I use section 27.....for this property..as I am paying the emi for years...i also hv child

Your question revolves around right as a owner over the flat where your are co borrower and paying the EMI in spite of surrender by your husband, under such situation you can claim title of such property and demand bank to release NOC in your name and if flat has registered yet then make separate agreement to builder or flat holder in your favour.
