Registration of missing person property

Dear sir/madam, my neighbors want to sell their agricultural land. The land is in the name of their father who has expired long back and they got death certificate. He has a son and 3 daughters, all are major. But the son has been missing for past 20 yrs and no police complaint has been filed. They want to sell their land and they have got legal heir certificate including the mother, son and 3 daughters. Is it advisable to buy the land and what procedures has to be followed to register the land. Thank you

You can very well purchase the land excluding the share of the missing son. The untraceability of the missing son must be legally proved before sharing the son's share in the land by others. Legal heir certificate includes the son's name and he cannot be deprived of his share in property until the same is proven legally.
