Dear Querist, Yes, the flat can be registered, but ONLY AFTER the Occupancy Certificate (OC) is officially generated and issued by the municipal authorities under the 2026 Amnesty Scheme. Registration cannot take place based merely on proof of an applied status. Under current Maharashtra Revenue Department rules, sub-registrars are strictly prohibited from registering properties in buildings lacking a valid OC. Because the building already has an IOD and CC from 2005, it possesses a legal foundation, making it highly eligible for regularization under the amnesty scheme. However, until the regularization process is complete and the final OC is in hand, the sub-registrar will reject the sale deed. My Advice: Do not execute a final sale deed or clear full payment yet. Instead, enter into an Agreement to Sale (ATS) with a strict clause stating that the final registration and balance payment are conditional upon the seller successfully delivering the final municipal OC.
