Registration of father(late) notary property
16-Apr-2025 (In Property Law)
Good Evening, We are family members of two sons and two daughters. Mother is also there. Sorry to say father is expired. all four members got married. Elder daughter got love marriage and not in contact. Amoung three siblings and mother got mutual understanding to get register father's name notary documented 92 yrds land on the name of younger son. What precautions to be taken to not to have future issues. Please suggest in this regard. Thankyou.
Since there is mutual understanding among the mother and three siblings to transfer the 92 square yards of land in the name of the younger son, it is important to take proper legal steps to avoid future disputes. First, obtain a legal heir certificate to officially identify all heirs of the deceased father. Then, all the legal heirs, including the mother and other siblings, should execute registered relinquishment deeds in favour of the younger son. Notarised documents alone are not legally valid for property transfer, so proper registration at the Sub-Registrar Office is necessary. After registration, update the property records like municipal records, tax receipts, and electricity bills in the younger son's name. Also, since the elder daughter is not in contact, a legal notice should be sent to her last known address informing her of the property transfer. This will act as a safeguard in case she raises any claim in the future. Taking these precautions will ensure that the property is legally secured in the younger son’s name without future legal complications.
