23-Feb-2023 (In Property Law)
2 years back i have purchased a property in Panvel with reputed builder as all clearance were in place. We have done the registration and paid service tax / VAT as well. Unfortunately, construction has stopped since then as builder is saying that he dont have any funds now. Please suggest what could be course of action against him. Thanks.

As buyer you have right to take possession of the flat on time as promised in agreement to sell. If unable to get it on time then you can approach the consumer court for getting the compensation from builder.

As you have been booked property which is under construction, the period of completion of the building might be specified by the builder as per your agreement with him.And if he failed in completing the terms and conditions of agreement you can take action against him for breach of contract and ask him for specific performance in Civil Court.contact me please!

Option 1 - Approach the Consumer Forum Court and file your complaint for deficiency in services by builder.
Option 2 - File a suit in regular civil court for timely specific performance of contract.
Option 3 - File a suit in Civil Court for cancellation of registered agreement and for refund of money you paid, if in case, if you are now not interested in that property.
