Regarding water leakage in the common path between our houses

06-Feb-2026 (In Property Law)
I am seeking legal guidance regarding a recurring civil dispute in Madurai. A neighbor's drainage pipe is leaking into the common path (general vazhi) between our houses, creating a health hazard and damaging the path.

The situation you described constitutes a Private Nuisance and a violation of public health standards. Under Indian law, you have several avenues for redress: Legal Notice: Your first step should be to issue a formal legal notice through an advocate, demanding the neighbor repair the leakage within a specific timeframe (e.g., 7–15 days). Civil Suit: You can file a suit for Permanent Injunction in a local civil court in Madurai to restrain the neighbor from discharging sewage into the common path. You may also claim damages for any repairs needed for the path. Local Municipal Authority: Since this is a health hazard, you should file a written complaint with the Madurai City Municipal Corporation. Under the Tamil Nadu District Municipalities Act, authorities have the power to compel owners to fix defective drainage. Police Complaint: If the neighbor is aggressive, a complaint can be lodged under Section 268/290 of the IPC (Public Nuisance).

If you live within Madurai City Corporation limits, lodge a written/online complaint with them. Or, with the local panchayat union. If no action is taken, escalate your grievance to CM's special cell, Mudalvarin Mugavari.
