Regarding the selling of the property

The seller sold me title litigated property, which I came to know at a later stage. And the seller who sold the property to the seller who sold me has been fighting the case in district court regarding the title litigated property. Now if he loses the case in district court and if I tell him and if he appeals in high court and the case while going in High court can I sell this property?

See you need to show your documents to a legal consultant or lawyer to understand the exact position of your property since you believe that the property was sold to you without proper title you enter into the same shoes that is the property title is not good in law if you sell it at this point maybe it is profitable to you but I can tell you the exact position of your title only after seeing all the documents of the case maybe you can enter into a compromise with the opposite party and give them the possession and have a better deal with then and you can also sue your the seller who sold you for cheating or giving wrongful property and in case if there was a stay on the property from being sold which is mostly in many cases then you never had any title in the property according to law so it all depends upon the facts and I can only advise your best and correct after seeing them you can take a legal consultation on the same

You can’t sold the property that is engaged in litigation. The opposite party must have demanded for permanent injunction that is the property must not be disposed off without the consent of the court.

Your question is that your litigation is pending and you want to know whether you will be able to sell the property or not …..if court has granted injunction on the property that you cannot sell the property until the case is pending or third party interest can’t be created ..in that situation you cannot sell the property at all and if you do so then it will be contempt of court …and the buyer will be impleaded too in the case.
