A disputed property in whatsoever manner cannot be sold. It would be illegal, a stay order can also be obtained likewise. but in case stay is ordered you cannot sell the property in question until stay is vacated from the court. the sale during this period would be void and you can land yourself in another case of cheating

No whole sale deed will not be invalid. You can request the seller to return the money with interest if you wish for the disputed land and in respect of undisputed land you may file a impleadment petition in the High Court pleading your grieivance.
