regarding registry of a dispute property
15-Jun-2023 (In Property Law)
I want to buy a land in West Bengal, I have the Deed Paper of the land. I have a question if their is a legal case or dispute is going on the property in the court, can i still do the registry? Does registry office knows about the dispute and don't allow to do registry?
No. The Registration authority cannot know about the dispute in court but if there is an order of injunction for non-transfer of the disputed property, then you cannot transfer it by way of registration. If you do so, then your registered deed will be voidable. The court may order under section 188 IPC against you. But if there is no such injunction order then you may transfer the property. For more queries, a consultation is required.
thanks.
