Refund of all taxes paid so far, for cancellation of apartment

06-Sep-2023 (In Property Law)
Hello, I have booked an under construction apartment in Bangalore last year from Godrej Properties. My bank and I have paid around 70% of amount incl (ST+VAT+ KKC+ SBC and GST recently). For personal reason, I have to cancel my apartment. My agreement says, amount would be refunded excluding all taxes paid. In such scenario, how can I get all the taxes refunded as I'm no more owning any apartment.

: You should apply for refund of the amount to the Godrej Properties and in case they deny your claim for refund on any ground then you can first serve them with legal notice through an advocate. There are chances that the dispute will come to an end at this stage only. In case your amount is not refunded within the period mentioned in the legal notice then you can file a civil suit for recovery of the amount. But make sure that the agreement has the provision for refund of amount excluding the taxes.

YOu can get back the amount paid to builder. The builder has already paid the taxes. It is not possible to get refund of tax already paid.
