Redevelopment consent and share certificate is not issue by society

30-May-2023 (In Property Law)
Our Mhada building is in redevelopment and most of members consented for that but committee does not entartaining to me for consent. I am not opposing the developer. And I am already applied for membership in society u/s 22(2) as per MCS Act 1960 in deputy registrar office. 1) So can anyone tells that without my consent developer proceed for redevelopment? 2) In which department I need to file a complaint? 3) Or I direct file a case in court?

You have to file the complaint directly with the slum rehabilitation authority in Mumbai and accordingly your grievances will be heard however if you are ye sole member opposing the redevelopment process then in that case no court will be in a position to give you the requisite relief

Well, you have to bring a Stay on Redevelopment. Either you have to file a Writ Petition if this Redevelopment Project is violating your fundamental rights guaranteed under the Indian Constitution or else you can file a PIL if the project is lethal for Public at Large due to Environment concerns or some other problems.
