Recovery suit in property suit in delhi

We had booked a property in DLF capital greens, Delhi through a dlf channel partner who had the flat allotted in his name and operates from within the premises. We paid 50 percent of the amount. Now he is saying to llok for another flat or he will give the money back. But till now he has not returned any money. We want to file a recovery suit. Need advice.
hello client as you said tht you paid half of the already but no flat delivered to you till now nor your money was given back .they are trying to convience you for another flat. in these conditions you havevto move thtough lwgal channel urgently instead of trying negotiate with tht fellow. in my openion you should urgently file legal cases against tht fellow slong with dlf so ur able to recover ur money with interest

Yes you can file a Suit for recovery and compensation before the Honorable Court having pecuniary and territorial jurisdiction. You have a good case. Please go ahead immediately. Better approach an experienced lawyer to issue a proper legal Notice as per law by taking all relevant pleadings which will be later on used while drafting a Civil Suit.
You have also another option to take action under CRIMINAL PROCEDURE CODE which is also available simultaneously.
