Question Regarding approaching IRP against Supertech Limited

मेने 2011 मे सुपरटेक लिमिटेड के एक प्रोजेक्ट मे एक फ्लैट बुक कराया था. जिसका possession मुझे 2015 मे मिलना था लेकिन नहीं मिला उसके बाद मेने UPRERA मे 2019 मे कंप्लेंट फ़ाइल की थी इसमें मुझे दिसंबर 2020 मे जिलाधिकारी गौतम बुद्ध नगर के नाम रिकवरी सर्टिफिकेट इशू हुआ था जिसमे जिलाधिकारी जी बिल्डर से मेरी अमाउंट रिकवर करके मुझे मेरी राशि वापिस दिलाएंगे लेकिन ऐसा नहीं हुआ उसके बाद मेने इलाहाबाद हाई कोर्ट मे रिट दाखिल की रिट मे 27 नवंबर 2021 मे आर्डर आया था की जिलाधिकारी जी मुझे 8 सप्ताह मे मुझे मेरी राशि वापिस दिलाएंगे परन्तु फिर ऐसा नहीं हुआ. फिर मेने इलाहाबाद हाई कोर्ट मे contemp of court का केस डाला जिसमे 10-03-2022 को आर्डर आया कि जिलाधिकारी जी मुझे 5 जुलाई 2022 तक मुझे मेरी राशि मुझे दिलाएंगे. परन्तु अचानक 25-03-2022 को सुपरटेक लिमिटेड को दिवालिया घोषित कर दिया गया है. अब में dilemma मे हु कि मुझे 5 जुलाई 2022 तक का वेट करना चाहिए या IRP को एप्रोच करना चाहिए? कृपया मुझे सही सलाह दे.
Hi.
You should approach the IRP. This is because there is a moratorium as soon as the resolution process begins so the proceedings in the High court won't take place. The high court does not have the power now.

It’s advisable that you approach and file ur claim with the IPR so I may be able to recover come money and rather waiting Incase u are able to recover something on 5th July that may be adjusted in ur total claims
Accordingly if u delay u may be causing risk to ur investments which r already in jeopardy due to status of Supertech
