Question regarding adverse possession
11-Jan-2025 (In Property Law)
I am living in a property from more then 50 years which is not in our name and the owner of property has not been interfere from the date we are living till now but now we want to register this property in our name . They are our relatives and there are minimum chances that they will have any problem on it because we have better relations with them .
What should we do if the descendents of the owner are agree and if they are not
If coowner agree relinquishment deed is an option when othe coowners give up there rights in the property in your favour, Family settlement deed is also an option. You may also get executed a sale deed in your favour from the true owner.
If they don't agree, you may claim a right under the doctrine of Ouster. It's the right against other coowners, for this you Ned to file a civil suite
