18-Sep-2023 (In Property Law)
Hi, My Grandfather and Grandmother had died. The property is in my grandfather's name and need to be transferred to my Father. My Father has 2 sisters who don't have any issue. Please let me know what is the best method to transfer. State is Punjab and we are Hindu. Since Punjab has done away with property transfer fee to blood relations, will that help in this case.

Sir, It is a very simple procedure to get the property transferred in your father's name. You just need to go and talk to patwari along with your father and his sisters and tell him to transfer the property in the name of father and his sisters will give no objection and the property will be transferred on the basis of natural succession.

There is no need pay any ashtam fees to the tune of 6% or otherwise. as property is not transfered but inherited. Law of inheritence will be applied. Only thing is file application of mutation (intqal) to Tehsildar. whuch will be marked to patwari. Who will do d needfull. And approved by then Tehsildar. Thing to be done is to get the application typed from an Advocate and take signatures of ur father and his sisters at relevant places. And if Tehsildar required their prezence they have to appear before him. Thats it. Mutation (intqal) will be entered in revenue enteries if not objected by anyone. For objection can be raised by anyone that he has a will in his favour from ur grandfather.
