Purchased a plot 20 years ago & we have all legal documents

We Purchased a plot & build home 20 years ago & we have all legal documents. Now another person gives us a notice & says this plot belongs to him & told us to appear in the civil court. So we appointed a lawyer who charged us Indian rupees 50,000/-. Kindly advise is it reasonable lawyer fee. Also kindly advise us how much time it takes to finish this case. Thank you.

If you have been in continuous possession of the property for the last 20 years with registered documents and construction, your legal position is comparatively strong. You should immediately contest the case by filing a detailed written statement and produce all title and possession documents before the court. It is also advisable to file a counter claim seeking declaration of title and permanent injunction, if necessary. Further, you must seek an interim injunction under Order XXXIX Rules 1 and 2 CPC to restrain the opposite party from interfering with your peaceful possession during the pendency of the suit. Courts generally protect long and settled possession unless the opposite party proves a better title. Civil property disputes usually take time as the matter proceeds through evidence and trial. Therefore, securing interim protection at the earliest stage is very important to safeguard your rights and prevent unnecessary complications.
