Property transfered from Grandfather to my mother's name
10-Dec-2024 (In Property Law)
Hello Sir,
I have one ancestral property which was transfered from my grandfather to my mothers name. Now, my mother is denying to give any share of that property to me. Can I file a suit in court for my legal rights and share in that property. Please suggest.
If the property was ancestral but transferred exclusively to your mother's name, it loses its ancestral character and becomes her self-acquired property. In such a case, she has the legal right to decide its distribution. However, if the transfer is questionable or you have evidence that the property remains ancestral, you can file a civil suit to claim your share. Consult a lawyer to evaluate your case and draft a partition suit or challenge the transfer if required.
